How can I have good credit again?
I have about $20,000 in credit card debt from four years ago. I have two student loans totaling approximately $7000 which are in default. I have a judgement against me for about $4300 from a credit card company. I have two overdrawn bank accounts that are closed. I have been in chexsystems before but I'm not sure if I am now. I think I have a few bad checks. I don't have a bank account now. How do I fix this? I want to have a normal financial situation once again not this chaotic debt. I have $229 to my name and some spare change. What do I do? (Serious answers only please.)

- Go back in time, and don't get yourself in over your head. Wait, you can't do that. Well, sorry to say, the only way to have good credit again is to pay the people you owe, get your bank accounts back in good standing, and begin using credit wisely when they grant you more. - I would contact a non-profit debt consolidation agency who can help you combine all of that debt into one monthly payment. That would get the student loans out of default and the judgement off and would probably lower the credit card debt by lowering your interest rates.

- You might want to start by getting a debt consolidator. This is definetly the best route to take. Your debt consolidator can probally knock off some of these expenses as well as combining it into one generally low monthly payment. The only other option I can see would to be is filing bankrupt. This will generally take about seven years afterwards to probally get where you want to be with your credit but, you will no longer owe anybody for any type of debt.
- The fastest way to re-establish your history is by paying your current obligations -- it may take 2-3 years of this behavior to improve your credit score. And, you will need to take care of any judgements, etc. Consumer Credit Counseling/Debt Reduction/Settlement Offers will NOT improve your credit -- these are all noted in credit reports. They may make it easier to pay off your debt, but creditors see this as not meeting your full obligation. While your credit score is important, most lenders look at other variables within a credit report --- CCC is a red flag for many lenders. If you truly cannot repay your debt, it is smarter to declare bankruptcy instead of going through the CCC route. Most CCC customers deteriorate into bankruptcy, anyway. These agencies make a tidy profit (although most claim they are 'non-profit') from upfront fees, customer payments and/or settlement offers --- they rarely act in the consumer's best interest. One or two years after filing for bankruptcy, you'll get credit offers again (although not under the best terms), as they know you can't re-file for another 5 years or so.
- Everyone makes mistakes. Its NEVER too late to start over. It may take time, effort and some money to repair the mess you are in however; it can be accomplished. I would reccommend the following: 1. Figuring out exactly what you owe. This can be done by getting all 3 credit reports. 2. Figure out how much money you can save evey pay day and stick to it. If you dont have money to save; get another job regardless of how much you dislike the idea. 3. Begin offering your creditors settlements when you have money accumulated. Offer 10 cents on the dollar and work your way up. Once your debts are settled, you can begin disputing the negative items with the credit bureaus. - It sounds to me like one has been in this situation for a while. Check with your state's Statue of Limitations. Credit cards are open accounts by the way, and student loans will always need payed. If one has been in the system for a while, chances are the SOL will run out soon if not already.......it is 3 years in my state from the date of last payment.........unless u have made a promise to pay, or told them u know the money is owed by u. Even if the debt is payed now, the bad credit--it will still be considered bad for 7 years on a credit report. Pay your student debt., anything else if a letter arrives, one has 30 dates to send a certified with receipt letter (about $5) asking for validation-dispute the debt. Unless one is making a lot of money, and has a lot of assets, or a steady job, it is unlikely that one will be sued. But the student loans have to be payed!

- You have received some good advice. I highly suggest that you get a list of all of your debts, and get a free consultation with a bankruptcy attorney. There is no obligation, and he/she will tell you all of your options. You will be required to see a credit counselor before filing bankruptcy, if you decide that is what you need to do. The attorney will give you a list of approved counseling agencies. You choose one, answer some questions, and if the counselor agrees that you need to file bankruptcy, they will give you a certificate allowing you to do so. However, being a bankruptcy paralegal, I can tell you that you will most likely have to repay the bad checks (and you want to do so quickly to avoid criminal charges against you), and you will NEVER get away from the student loans whether you file bankruptcy or not. Student loans will follow you for the rest of your life, it doesn't matter if you are disabled and on Social Security, they will take your money to pay those loans. If you only have $229, you may need to talk to a financial planner about what you need to do to manage your money more wisely. Or get a better paying job, but that is easier said than done.
